First Offense
BAC above .15 (but less than .20); or having any illicit drug or its metabolite in your system:

  • Sentencing can range from 30 days to six months in jail. The minimum sentencs is 30 days jail, and must serve entire sentence.
  • Eligible for work furloughs
  • A minimum of $250 fine, $210 surcharge, $1,000 prison fund, $1,000 public safety equipment fund, $20 time pay fee, $20 probation fee and $13 law enforcement assessment. Adding up to $2,763 in total fees, fines and payments.
  • License issues include nothing beyond admin Per Se: 30 days complete suspension; then 60 days restricted (to/from work/school) in MVD’s discretion.
  • Other consequences include: possible probation up to five years, alcohol/drug screening and classes, community service, pay for jail incarceration, possible monthly probation fees, possible SR22 insurance and one year Ignition Interlock

Second Offense
Second DUI must be within 84 months of any other DUI commission date:

  • Sentencing can range from 120 days to six months in jail. The minimum sentencs is 120 days jail, at least 60 days of which must be served consecutively, but must serve entire sentence.
  • Eligible for work furloughs
  • A minimum of $500 fine, $420 surcharge, $250 DUI fund, $1,250 prison fund, $1,250 public safety equipment fund, $20 time pay fee, $20 probation fee and $13 law enforcement assessment. Adding up to $3,713 in total fees, fines and payments.
  • License is revoked for one year. Possible to get To/From Work Permit. Defendant must pay to get license / privilege to drive reinstated after end of suspension.
  • Other consequences include: possible probation up to five years, alcohol/drug screening and classes, 30+ hours of community service, pay for jail incarceration, possible monthly probation fees, possible SR22 insurance and one year Ignition Interlock
