The Different Types of Scottsdale DUI Charges & Penalties for Each

In Arizona, there are different types of DUI charges that can be brought against you, if you are caught under the influence while driving. A first-offense DUI is generally a misdemeanor, but even this could have dire consequences.

The different types of DUIs are as follows…

Misdemeanor/Regular Scottsdale DUI (First Offense)

If you get stopped by law enforcement while driving and test positive for alcohol consumption with a concentration of 0.08 or more in your blood or 0.04 for those with a DUI with a CDL (commercial driver’s license), then you will be arrested and charged with Driving Under the Influence (DUI).

However, even if your alcohol levels are 0.05 you may face criminal charges on the presumption you are under the influence, or DUI to the slightest degree.

Penalties for First Offense DUI in Scottsdale

  • Spend “ten” days in jail, not eligible for probation or suspension, unless the entire sentence is served.
  • Pay no less than a $250 fine.
  • Possibly ordered to perform community restitution.
  • Pay a $500 assessment fee.
  • Pay an additional $500 assessment fee.
  • If intoxicating liquor was involved in the violation, the person will be required to equip their motor vehicle with a certified ignition interlock device for 12 months or more, pursuant to section 28-3319.
  • Complete a traffic survival course.

Extreme DUI / Super Extreme DUI

If you are stopped while driving and test positive for alcohol consumption with a concentration level of 0.15 or more but less than 0.20 you will be charged with an “extreme DUI”. Concentration levels of more than 0.20 shall be charged with a super extreme DUI.

Penalties for Extreme DUI / Super Extreme DUI Charges in Scottsdale

  • Serve no less than “thirty” consecutive days in jail for extreme DUI and forty-five for super extreme DUI, not eligible for probation or suspension, unless the entire sentence is served.
  • Pay no less than a $250 fine for extreme DUI and $500 for super extreme DUI.
  • Possibly ordered to perform community restitution for both extreme and super extreme DUI.
  • Pay a $1,000 assessment fee for both extreme and super-extreme DUI.
  • Pay an additional $250 assessment fee for both extreme and super-extreme DUI.
  • Pay an additional $1,000 assessment fee for both extreme and super-extreme DUI.
  • If intoxicating liquor was involved in the violation, the person will be required to equip their motor vehicle with a certified ignition interlock device for 12 months or more, pursuant to section 28-3319 for both extreme and super extreme DUI.
  • Complete a traffic survival course for both extreme and super extreme DUI.

Felony Aggravated DUI

An aggravated DUI in Scottsdale, AZ. consists of additional “aggravating factors” that turn a misdemeanor into a felony, which is a much more serious charge. This happens when other conditions are present at the time of arrest, including:

  • Arrested for a Second DUI or Third DUI within 7 years.
  • Driving under the influence with a child or passenger under the age of 15.
  • Driving under a Revoked, suspended, or restricted license.
  • Alcohol consumption resulted in people or property damage.
  • A DUI car accident that caused injury
  • Driving without an interlock device when required to.

Penalties for Aggravated DUI

A Felony Aggravated DUI is a felony subject to much harsher punishment. When charged with Aggravated DUI, you can expect the following penalties:

  • More jail time of at least 4 months
  • Fines and assessment charges for over $3000
  • A 3-year license suspension
  • A mandatory ignition interlock device for at least 24 months
  • Many more hours of counseling classes
  • Probation that could last ten years or more
  • A permanent felony on your record that could ruin your future

However, refusing to take the tests will result in a one-year suspension of your driver’s license (two years if you refused a test within the past 84 months). First, the officer will confiscate your driver’s license and issue you a temporary one that is valid for 15 days. Next, your license will be suspended which will take effect in 15 days.

If you had been drinking, it is up to you to weigh out the consequences: a year of using public transportation or being arrested and sitting in jail, paying multiple fines, taking classes, and more. What’s the worst that can happen? The officer could issue a warrant to make you comply and take the test, but he would have to be certain that you had been drinking to do this.

In the case you are arrested, invoke your right to an attorney and remain silent. Keep in mind you can’t talk your way out of this one, but you may say enough to put yourself in more hot water.
