Domestic Violence Dismissed at Trial
Our client found himself in a challenging situation when a verbal argument with his wife escalated, leading to a series of unfortunate events. During the argument, his wife accidentally dialed 911 but quickly hung up, realizing her mistake. Despite the hang-up, law enforcement was dispatched to their residence to investigate the situation further.
When the police arrived, they observed a broken flower pot on the floor and noticed that our client had scratch marks on his face. Based on these observations, they made the decision to arrest him on charges of domestic violence despite the lack of evidence that he was an aggressor.
The circumstances were far from straightforward. Our client’s wife, who never intended for the situation to escalate to this point, had no desire to pursue any form of prosecution against her husband. Complicating matters further, our client wisely chose to exercise his rights by remaining silent after being read his Miranda Rights, refusing to make any statements that could be used against him in court.
Recognizing the weaknesses in the state’s case, we immediately began working to have the charges dismissed. We presented a strong argument, pushing the state to drop the case early on, emphasizing the lack of evidence and the fact that the alleged victim, our client’s wife, was not seeking prosecution. Unfortunately, the state refused to dismiss the charges at that stage, opting instead to proceed to trial.
This victory emphasizes the importance of a powerful domestic violence attorney, especially in cases where the evidence is not as it first appears. Through persistence, strategic planning, and a commitment to justice, we were able to achieve the best possible outcome for our client.
